Terms and Conditions of Gaia Villas
Introduction
Gaiavillas.com ("we", "us", "our") is the trading name of Gaia Turizm Ticaret whose registered office is at Foça Mahallesi 966 Sok. No: 51/D Fethiye, Muğla. We act as an intermediary between villa/apartment/yacht owners, car hire/airport transfer service providers providers (“Owner”) and travellers/renters (“Guest”, “you”, “your”). We do not own or control those who actually provide the accommodation, car hire, other transport, or other services which you book through us. We accept no liability in relation to any contract the guest enter into or for property you book through this website (“Property”) or for the acts or omissions of any supplier(s) or other person(s) or party(ies) connected with any Property.

1. Accuracy of Information
1.1 We work systematically to provide you the accurate details of the products at our website but we do rely upon the descriptions given to us by the actual suppliers of the services and facilities described. Sometimes the accommodation or service providers can changes. Where our suppliers advise us about significant changes to descriptions or about the withdrawal of any significant facility, we will tell you as soon as possible. All accommodation providers reserve the right to collect a refundable breakages deposit on arrival. Any transfer times we quote for travel between airport and resort are approximate and, depending on circumstances, the journey time to your own chosen property may be longer.
1.2 We are not liable for errors within our website descriptions which are as a result of the incorrect information provided by our from our suppliers.
1.3 The Guest acknowledges that the property is not a hotel but a private accommodation being let for self-catering holidays. The Guest further accepts that the property does not have standards or categories recognised internationally, but instead reflects, in its architecture and furnishings, the local traditions and personal taste of the Owner.
2. Booking & Payment
2.1 By making a booking, the Guest agrees that on behalf of her/himself and all those named on the booking:
a. The Guest has read these Terms and Conditions and agree to be bound by them;
b. The Guest consent to our use of your information in accordance with our Privacy Policy;
c. The Guest is over 18 years of age and where placing an order for services with age restrictions you declare that you and all members of your party are of the appropriate age to purchase those services.
d. It is the Guest's responsibility to check the documents she/he received and notify us of any errors within 48 hours of receipt. If errors for which the guest hold us at fault are reported after this time, we cannot be held responsible for any costs associated with correcting these and the guest will be referred to the supplier’s terms for correction.
2.2 A non-refundable deposit between 15-25 % is required to make a villa or apartment booking (depending to the property) and 50% deposit is required for yacht booking (the balance is payable during check-in). The guest must also pay all applicable booking fees.
2.3 Once this has been paid it is non-refundable as a cancellation would not leave the Owner with sufficient time to find a substitute booking.
2.4 Your booking is confirmed and a contract between you and the Owner will exist when we send you confirmation on their behalf. This will usually be within 48 hours of receipt of your payment. Until the booking has been confirmed it is only a provisional booking. Please check your confirmation carefully and report any incorrect or incomplete information to us immediately. Please ensure that names are exactly as stated in the relevant passport. As we act only as booking agent, we have no responsibility for any errors in any documentation except where an error is made by us.
3. Prices
3.1 We reserve the right to amend advertised prices at any time.
3.2 All prices displayed on our website are for guidance only and are subject to change due to exchange rate fluctuations.
4. Payment Types
4.1 We accept the following forms of payment:
(a) Credit Cards
(b) American Express
(c) Bank Transfers are accepted on balances over £ 500.
4.2 If you have made an overpayment on your booking and wish for a refund, a handling charge of £5 will apply. This is necessary due to the processing charges incurred.
5. Changes and Cancellations by You
5.1 Any cancellation or amendment request must be sent to us in writing, by email and will take effect on the day we receive it. Amendments and cancellations can only be accepted in accordance with the terms and conditions of the Owner of the Property.
5.2 If the guest wish to amend her/his booking, whilst we will try to assist, we cannot guarantee that such requests will be met. Please ensure that you have received written confirmation of any changes to your booking. The Owner may charge an amendment fee and in addition the guest must pay us an administration fee of £ 20.00.
5.3 Please note that in the event the guest wish to cancel confirmed booking, no refunds will be given in any circumstances. The deposit is nonrefundable. This policy directly reflects the Owner's' individual policies, and you should therefore take out suitable travel insurance to cover the risks that may lead to such an eventuality. Due to the Owner's' individual policies For the cancellations made 15-29 days prior to the check-in date, 50% of the total amount should be paid. For the cancellations made 1-14 days prior to the check-in date, 100% of the total amount should be paid.
6. Changes and Cancellations by the Owner
6.1 We will inform you as soon as reasonably possible if the Owner needs to make a significant change to your confirmed arrangements or to cancel them. We will also liaise between you and the Owner in relation to any alternative arrangements offered by the Owner (if any) but we will have no further liability to you.
6.2 In the event the booking is cancelled by the Owner of the property and no alternative can be offered, a full refund of all monies paid by you as at the date of cancellation will be made by the Owner. This policy directly reflects the Owner's' individual policies. ‘Gaiavillas’ cannot be held liable for any additional costs incurred by the Client (such as travel). 'Gaiavillas' recommends that the Client takes out holiday insurance to ensure against any losses incurred by an owner cancellation.
7. Capacity
It is a booking condition that the number of people occupying the property may not exceed the advertised capacity, without prior written consent. Owners may terminate your booking without refund in the event you breach this condition.
8. Travel Arrangements
Do not make irreversible flight or travel arrangements until you have received final confirmation of your booking.
